Cincinnati Enquirer: Clerk of Courts ordered to reinstate online access to thousands of eviction cases

In a statement, the municipal court's presiding judge, Josh Berkowitz, said the appeals court made "an important decision regarding public access to court records."

Berkowitz said he and his colleagues appreciate "the clarity of the appeals court's directive to the clerk of courts."

"Court records belong to the public," he said.

Appeals court orders Hamilton County Clerk of Courts to put thousands of eviction cases back online

In early 2024 the Hamilton County Clerk of Courts filed a lawsuit against the judges of the Municipal Court.  The dispute arose when the clerk unilaterally removed thousands of Municipal Court records from his public website without notice to or authorization from the court. In response, the judges of the Municipal Court ordered him to restore those records to full public access. Rather than comply, he sued the judges. On September 27, an Ohio appeals court held that the Municipal Court was correct and ordered the clerk to comply with the Municipal Court’s order to restore public access to the records.
